Industrial, Commercial and Institutional Toilet Replacement Program Terms and Conditions
1. Purchase must be made between January 1, 2012 - December 31, 2012. All submissions must be received within 90 days of the date indicated on the proof of purchase. Final submission date is March 31, 2013. Submissions received longer than 90 days after the indicated purchase date cannot be honoured.
2. Purchase must be of a qualifying HET (High Efficiency) or DF (Dual Flush) gravity fed toilet(s) meeting WaterSense® guidelines or a qualifying efficient flushometer toilet and be installed in an industrial, commercial and/or institutional facility within The Regional Municipality of York. 3. Copy of Proof of Purchase document (sales receipt) must clearly indicate: name, address, and phone number of retailer and/or contractor; date of purchase; toilet model name, manufacturer, and model number; and number of qualifying toilets purchased.
4. Application form must be completed in full.
5. An applicant may submit more than one application provided that the application pertains to different toilets in the same building.
6. The property where the toilet(s) are installed must be an industrial, commercial, and/or institutional facility located within The Regional Municipality of York.
7. This promotion is applicable to industrial, commercial, and institutional facilities only and is not available for single family residences or multiple unit residences or contractors.
8. Offer valid only for toilets installed as retrofits in existing industrial, commercial, and/or institutional facilities. Toilets purchased for new construction do not qualify.
9. The applicant shall be responsible for determining the suitability of the HET or DF toilet(s) for the building, and the applicant hereby releases The Regional Municipality of York for any and all claims relating to this matter.
10. The Regional Municipality of York does not warrant the quality of workmanship, the suitability of the premises or the toilet for installation, or that the performance of any toilet or its installation will be free of defects.
11. The applicant shall indemnify and hold harmless The Regional Municipality of York, its officers, council members, partners, agents and employees, from and against all liabilities and damages, in any way based upon or attributable to, the applicant's participation in the Water Efficient Toilet Rebate Program.
12. The Regional Municipality of York reserves the right to alter, cancel or discontinue this program at any time and to reverse the rebate if the information provided by the applicant is either incorrect, or untrue, or if the Terms & Conditions of this program have not been met.
13. Applicant must provide proof of business location and ownership of facility or building through the submission of the most recent property tax bill from one of York Region's nine municipalities; confirmation that the gravity fed toilets removed flush at 6 L or higher or were installed prior to 1996.
14. Prior to approval of rebate, applicant must submit an invoice for purchase and/or final installation of a qualifying toilet dated within 90 days of the submission of the application.
15. Prior to approval of rebate, applicant must agree to an onsite verification of 10 percent of the new fixture installations in each building within 30 days of application if the applicant is applying for rebates of 30 or more toilets.
16. The Regional Municipality of York reserves the right to inspect the installation of the toilet(s) and flush volumes of each new toilet. This may include an inspection of the residence/building to monitor and evaluate efficiency of the unit(s).
